for the provision of services by Elena Fischer, c/o IP-Management #12218, Ludwig-Erhard-Str. 18, 20459 Hamburg, e-mail: fischer (at) aiastrologie.com (hereinafter the “Contractor”) towards her customers (hereinafter the “Client”)
1. General
1.1 These Terms and Conditions for the provision of services apply to contracts concluded between the Client and the Contractor with these Terms and Conditions incorporated.
1.2 Insofar as, in addition to these Terms and Conditions, further contractual documents or other terms of business in text or written form have become part of the contract, the provisions of those further contractual documents shall take precedence over these Terms and Conditions in the event of a conflict.
1.3 Terms and conditions used by the Client that deviate from these Terms and Conditions are not recognised by the Contractor – unless expressly agreed to.
1.4 The offers are directed at persons aged 18 and over. Minors may use the consultation only if a legal guardian (e.g. mother or father) has given prior consent and supervises the use. Proof of this consent must be provided to the Contractor before the first consultation: through personal contact by the legal guardian by e-mail (fischer (at) aiastrologie.com) or by telephone with suitable evidence. Without this proof, no contract is concluded with minors.
2. Subject Matter of the Contract and Scope of Services
2.1 The Contractor, as an independent entrepreneur, provides the following services to the Client:
Paid AI-supported astrological consultation via chat and voice output on aiastrologie.com. The consultation is provided by AI advisors (currently Leo, Neo Premium and Kosmiel – artificial intelligence, not real persons) based on the AstroEris teaching. The content serves life orientation and entertainment purposes; an AI can make mistakes. The consultation does not replace medical, psychotherapeutic, legal or financial advice.
2.2 The specific scope of services is the subject of individual agreements between the Contractor and the Client.
2.3 The Contractor shall provide the contractually agreed services with the greatest possible care and conscientiousness in accordance with the latest state of the art, the latest rules and findings.
2.4 The Contractor is obliged to provide the contractually owed services. In carrying out her activities, however, she is not subject to any instructions regarding the manner in which her services are provided, the place of performance or the time of performance. She will, however, arrange the days of activity and the allocation of time on those days herself in such a way that optimal efficiency is achieved in her activities and in the realisation of the subject matter of the contract. The provision of services by the Contractor takes place solely in consultation and coordination with the Client.
2.5 The responses of the AI advisors are generated automatically on the basis of probabilities (probabilistic method). They may therefore contain errors, in particular: factually incorrect or incomplete statements; invented information, data or sources that appear genuine (so-called hallucinations); unverified claims; and different answers to the same question. The Contractor provides no guarantee as to the accuracy, completeness or currency of the AI output. The Client shall check the answers themselves before using them further. The consultation is no basis for decisions concerning health, law or money; such matters are the responsibility of doctors, lawyers or financial professionals (cf. Section 2.1).
2.6 The Contractor endeavours to keep the AI advisors available with as few interruptions as possible. There is no entitlement to uninterrupted availability. Maintenance work, technical faults and outages of the third-party services used (e.g. AI service providers, voice output, payment services) may temporarily restrict use. If a consultation that has already been paid for is not possible due to a technical fault on the Contractor’s side, it will be made up for or the price paid will be refunded.
3. Duties of the Client to Cooperate
3.1 It is the Client’s responsibility to provide the information, data and other content required for the performance of the services completely and correctly. The Contractor is in no way responsible to the Client for delays in the provision of services caused by late and necessary cooperation or contributions by the Client; the provisions under the heading “Liability/Indemnification” remain unaffected.
3.2 Only the first name and the birth data (date, time, place) of the Client are required for the consultation. All further details that the Client provides in the conversation are voluntary and are given at their own discretion; the Contractor does not request them and does not need them.
3.3 Voice input via the microphone is a voluntary additional function. It uses the speech recognition of the respective browser; the voice is not transmitted to the Contractor’s servers. The Contractor provides no guarantee for this and other additional browser functions. Details are governed by the Privacy Policy.
4. Remuneration and Payment
4.1 The prices displayed on aiastrologie.com at the time of booking apply. All prices are final prices and include the statutory VAT of 19 %.
4.2 The remuneration is due before the start of the consultation. Payment is made via PayPal or Stripe (credit card). No subscription is created; each consultation is booked and paid for individually. Payment data is processed exclusively by the respective payment service.
4.3 After payment, the Client receives a confirmation by e-mail; upon request, the Contractor will issue an invoice by e-mail (e.g. as a PDF).
4.4 The Contractor is entitled to change the prices for future bookings at any time. For a consultation that has already been booked and paid for, the price displayed on the website at the time of booking always applies.
5. Right of Withdrawal for Consumers
5.1 Consumers have a statutory right of withdrawal. The details are set out in the Withdrawal Notice. The withdrawal can also be declared via the “Withdraw from contract” button on this website.
5.2 The right of withdrawal expires in the case of a contract for the provision of services if the Contractor has provided the service in full and only began performing it after the Client gave their express consent and at the same time confirmed their knowledge that they lose their right of withdrawal upon complete performance of the contract by the Contractor (Section 356 (4) of the German Civil Code (BGB)).
6. Termination of a Consultation and Crisis Situations
6.1 The Contractor is entitled to end a consultation if a) statements become apparent that indicate suicidal thoughts, intentions of self-harm or an acute mental health crisis, b) the Client reports current domestic violence or a comparable acute danger, c) the Client states that they have not yet reached the age of 18 (Section 1.4), d) the Client states that they are undergoing psychotherapeutic or psychiatric treatment, e) the Client behaves in an insulting or threatening manner or uses grossly pornographic language, or f) a technical fault makes continuation impossible.
6.2 Crisis situations. If indications of suicide, self-harm or the intention to harm others become apparent, no astrological interpretation takes place. Professional help is pointed out once and the consultation is ended:
In a life-threatening emergency, call your local emergency number (112 in the EU). Free crisis helplines worldwide, around the clock: findahelpline.com – choose your country.
The AI advisors are no substitute for professional psychological or psychiatric help.
6.3 In cases a), b) and d), appropriate help is pointed out.
6.4 If a consultation was paid for and ended under letters a) to d) or due to a technical fault on the Contractor’s side, the price paid will be refunded. In all other cases, the termination does not give rise to an automatic claim; the Contractor decides on refunds on a case-by-case basis.
7. Liability / Indemnification
7.1 The Contractor is liable without limitation on any legal grounds in cases of intent or gross negligence, in the event of intentional or negligent injury to life, body or health, on the basis of a guarantee, unless otherwise provided in that respect, or on the basis of mandatory liability. If the Contractor negligently breaches a material contractual obligation, liability is limited to the foreseeable damage typical of the contract, unless liability is unlimited pursuant to the preceding sentence. Material contractual obligations are obligations which the contract imposes on the Contractor according to its content in order to achieve the purpose of the contract, the fulfilment of which makes the proper performance of the contract possible in the first place and on compliance with which the customer may regularly rely. In all other respects, liability of the Contractor is excluded. The above liability provisions also apply with regard to the Contractor’s liability for her vicarious agents and legal representatives.
7.2 For damage arising from incorrect or incomplete AI output, the liability of the Contractor is – to the extent permitted by law – limited to the framework of Section 7.1. This applies in particular if the Client adopts AI output unchecked contrary to Section 2.5 or bases decisions solely on it.
7.3 The Client shall indemnify the Contractor against any claims by third parties asserted against the Contractor due to breaches by the customer of these contractual terms or of applicable law.
8. Term of Contract and Termination
8.1 The term of the contract and the notice periods for ordinary termination are agreed individually by the parties.
8.2 The right of both parties to terminate without notice for good cause remains unaffected.
8.3 Upon termination of the contract, the Contractor shall immediately return or destroy, at the customer’s choice, all documents and other content provided to her. The assertion of a right of retention in this respect is excluded. Electronic data shall be deleted completely. Excluded from this are documents and data subject to a longer statutory retention obligation, but only until the end of the respective retention period. Upon request, the Contractor shall confirm the deletion to the company in writing.
9. Confidentiality and Data Protection
9.1 The Contractor shall treat all matters that come to her knowledge in connection with the engagement as strictly confidential. The Contractor undertakes to impose the duty of confidentiality on all employees and/or third parties who have access to the information covered by the contract. The duty of confidentiality applies without limitation in time, beyond the duration of this contract.
9.2 The Contractor undertakes to comply with all data protection regulations when carrying out the engagement – in particular the provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
10. Copyright and Protection of Content
10.1 All content of the website aiastrologie.com – in particular texts, logos and design, the AI advisors Leo, Neo Premium and Kosmiel together with their images, depictions and personality descriptions, as well as the AstroEris teaching – is protected content of the Contractor.
10.2 Copying, reproducing, distributing, making publicly accessible or imitating this content – including in part, including as a template or “inspiration” for one’s own offerings – is not permitted without the prior written consent of the Contractor. Uses permitted by law (e.g. the right of quotation) remain unaffected.
10.3 In the event of infringements, the Contractor reserves the right to take legal action.
10.4 The Client may freely use and store the content generated in the course of the consultation (texts and voice output) for private, non-commercial purposes. No exclusive right of use is granted; identical or similar content may also be generated for other customers. Publication or commercial use of the consultation content requires the prior consent of the Contractor.
11. Final Provisions
11.1 The law of the Federal Republic of Germany applies, excluding the CISG.
11.2 Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining Terms and Conditions shall not be affected.
11.3 The Client shall support the Contractor in the provision of her contractual services through reasonable acts of cooperation, insofar as necessary. In particular, the Client shall provide the Contractor with the information and data required to fulfil the engagement.
11.4 If the Client is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the parties agree that the Contractor’s registered office shall be the place of jurisdiction for all disputes arising from this contractual relationship; exclusive places of jurisdiction remain unaffected.
11.5 The Contractor is entitled to amend these Terms and Conditions for objectively justified reasons (e.g. changes in case law, legislation, market conditions or business or corporate strategy) and subject to a reasonable notice period. Existing customers will be notified of this by e-mail no later than two weeks before the amendment takes effect. If the existing customer does not object within the period set in the notice of amendment, their consent to the amendment is deemed to have been given. If they object, the amendments do not take effect; in that case the Contractor is entitled to terminate the contract extraordinarily as of the date the amendment takes effect. The notification of the intended amendment of these Terms and Conditions will point out the deadline and the consequences of objecting or failing to object.
